Welcome to customisepremium (“Platform”, “We”, “Our”). Please read these Terms and Conditions carefully before using our services.

By accessing or using our e-commerce website and related services, you fully agree to these Terms and Conditions. If you do not agree with any part of these terms, please do not use the Platform.

1. Description of the Service

customisepremium provides a system that allows you to:

  • generate custom designs and images using artificial intelligence
  • create personalized products (clothing and other items) through the Printify service
  • purchase the personalized products you have created.

Product manufacturing and shipping are managed by Printify Inc., based in the United States, as a third-party supplier.

2. Orders and Production

All customized products are made to order (“print-on-demand”).

  • Once the order is confirmed, the information is sent to Printify for production and shipping.
  • Production and shipping times may vary depending on the type of product and delivery address.
  • Please carefully check the generated previews before confirming your order: it is not possible to modify or cancel an order after confirmation, except as required by law.

3. Prices and Payments

  • Product prices are shown in [currency, e.g. euro] and include VAT, unless otherwise stated.
  • Any shipping costs are calculated and displayed during checkout.
  • Payment is made using the available methods (e.g. credit card, PayPal, etc.) at the time of ordering.

4. Shipping and Delivery

  • Delivery times are estimates provided by Printify and depend on the destination country and production volume.
  • We are not responsible for any delays caused by Printify, the courier, or force majeure events.
  • Once your order has been shipped, you will receive a confirmation email.

5. Returns, Replacements and Refunds

As these are personalized products, we do not accept returns or refunds, except if the product is defective or damaged upon delivery.

In case of a defective item:

  • Contact us within 14 days of receipt at support@customisepremium.com.
  • You will be asked to provide detailed photos of the defect.
  • After verification, we will proceed with replacement or refund, depending on availability.

6. Intellectual Property Rights

  • By using the AI generator, you guarantee not to create content that infringes on third-party rights (trademarks, copyrights, privacy).
  • By creating content, you grant us the right to use the designs solely for production and order management purposes.
  • The user is responsible for any content uploaded or generated through the platform and releases customisepremium from any liability arising from unlawful use.

7. Limitation of Liability

  • The platform is provided “as is”, without guarantees of continuity or error-free operation.
  • We are not responsible for any indirect or consequential damages arising from the use of the platform or Printify services.
  • Any liability shall in any case be limited to the amount paid for the disputed order.

8. Terms on the Visibility of Generated Products

The personalized products created by the user within the platform are initially considered private and therefore visible and purchasable only by the user. If the user voluntarily chooses to use the sharing function, they expressly agree that the product becomes public and thus accessible to all platform users, who may freely view and purchase it. The responsibility for making a product public lies entirely with the user. Each time a user makes their product public and it is subsequently purchased by other users, the author will receive a credit for each purchase. This recognition system aims to encourage the publication and sharing of personalized products, fostering active community participation.

9. Changes to the Terms

We reserve the right to modify these Terms at any time. Changes will take effect from the date of publication on the website.

10. Governing Law and Jurisdiction

These Terms are governed by Italian law. The Court of Palermo shall have exclusive jurisdiction over any disputes.
